The creation of subdivisions consisting of five or more residential lots or units falls within the jurisdiction of the California Department of Real Estate (“DRE”). No subdivision interest can be offered for sale or lease until the appropriate documents have filed with, reviewed and approved by the DRE and some form of Public Report is issued for the subdivision.
